Arizona is considered a "no-fault" divorce state.  This simply means that the person filing for divorce does not have to allege grounds such as adultery or abandonment.  The only requirement is that the marriage is "irretrievably broken".  There is a six-month residency requirement for at least one of the parties.  In a no-fault divorce, the petitioning party (person filing for divorce) must appear briefly in court to testify that both parties agreed to the divorce.  A Final Judgment of Dissolution of Marriage is then issued by the Judge, making the divorce final.

In order to qualify for an uncontested divorce, various criteria must be met:

~ Your spouse must agree to sign the necessary paperwork.

~ You must be separated from your spouse.

~ You must agree to the division of all assets and liabilities.

~ You must agree to be jointly liable for any tax liability through the end of the year in which the divorce becomes final.

~ Divorcing couples with children are required to attend a parenting class
